If you fail to comply with your obligations under the OSH Act, you will face various fines and penalties. Fines for violation of the provisions of the OHS Act: this article briefly summarises the penalties for non-compliance with safety regulations.
According to Act No. 125/2006 Coll. (On Labour Inspection) as amended, are imposed by the Labour Inspectorate. It may do so up to 3 years after the breach of obligations. So what fines can apply to you?
Breach of employer’s obligations
EUR 3 300 to EUR 33 000 (up to twice as much)
For breaches of obligations arising from this Act, from the regulations referred to in section 2(1)(a) or for breaches of obligations arising from collective agreements.
If, as a result of the breach, the employee suffers a fatal accident at work, at least EUR 3,300; for failure to comply with an obligation imposed under section 12(2)(b) to (i), you may receive up to twice as much.
Infringement of the obligations of a natural person who is an entrepreneur (sole trader)
EUR 3 300 to EUR 33 000 (up to twice as much)
At least EUR 3 300 for breach of the obligations arising from this Act and from the regulations referred to in Section 2(1)(a) of this Act. If the breach results in a fatal work-related accident to an employee, you may receive up to twice as much for failure to comply with the obligation imposed under Section 12(2)(b) to (i).
Senior staff and public authorities
four times the average monthly earnings
The Inspectorate may also fine senior employees and statutory bodies in accordance with a special regulation. The fine shall be imposed on those who, through their fault, have violated obligations arising from the regulations referred to in Section 2(1)(a) or obligations arising from collective agreements, or have given instructions for such a violation, or have concealed facts relevant for the performance of labour inspection.
Carrying out an activity without authorisation
up to EUR 33 000
A fine may also be imposed on a natural or legal person who carries out, without an authorisation, certificate, licence or permit, an activity for which an authorisation, certificate, licence or permit is issued by the National Labour Inspectorate, the Labour Inspectorate, a natural person or a legal person pursuant to a special regulation.
Failure to report an accident at work
from EUR 65 to 650
The Inspectorate may also impose a regulatory fine on employees or natural persons who are entrepreneurs (tradesmen) who have not fulfilled their obligations under Section 16 within a specified period of time and have not immediately reported the occurrence of a serious occupational accident, the imminent threat of a serious industrial accident, a serious industrial accident, an occupational disease and the threat of an occupational disease pursuant to a special regulation.
Obstruction of inspection
from EUR 65 to 650
The Inspectorate may also impose an administrative fine on a natural person who is present at the employer’s workplace and obstructs the performance of a labour inspection.
